Alain Barbeau, owner of BaseDPsy PsyTablet (hereinafter “BaseDPsy“) operates the BaseDPsy site (hereinafter “the Site“). The designer, editor and producer of this Site is BaseDPsy. Use of the Site is governed by the terms and conditions reproduced below, which constitute a contract between you and BaseDPsy. These terms and conditions may be modified at any time by BaseDPsy.

PLEASE READ THEM BEFORE USING THE SITE. IF YOU USE THE SITE, YOU ACKNOWLEDGE THAT YOU HAVE PREVIOUSLY READ AND UNDERSTAND THE TERMS AND CONDITIONS LISTED BELOW. IF YOU DO NOT WANT TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT USE THE SITE.

TERMS OF USE

  1. Location of Operation and Jurisdiction
    BaseDPsy operates its Site from its offices located in Laval. Persons who choose to use the Site do so of their own free will and are responsible for compliance with all applicable local laws in the territory of the Province of Quebec. They acknowledge that the courts of the province of Quebec, district of Montreal, will have exclusive jurisdiction to decide any dispute that may arise from the use of the Site.
  2. Site Content and Use
    All materials contained on the Site, such as text, articles, photographs, illustrations, images, videos, or audio materials are the property of BaseDPsy or are subject to licenses or agreements entered into with BaseDPsy to permit their distribution. No part of the Site may be copied, reproduced, distributed, published, translated, downloaded, displayed or transmitted in any way without the prior written permission of BaseDPsy. Permission is granted to display or download materials from the Site solely for testing or for personal, non-commercial use, provided that no modifications are made and all intellectual property notices are displayed in full.
  3. Logos and Trademarks
    The trademarks and logos used or displayed on the Site are registered or unregistered trademarks of BaseDPsy or third parties. Nothing in the Site should be construed as granting, directly or indirectly, permission to use any of these marks without the prior written permission of the owner of such trademark.
  4. Limitation of Liability
    All materials contained in the Site and the Site itself are provided on an “as is” basis without warranty of any kind, either implied or expressed. Subject to any public policy legislation to the contrary, BaseDPsy disclaims all liability and gives no warranty. BaseDPsy makes every effort to ensure that the Site contains no errors and disclaims all liability for any errors that may occur. BaseDPsy, its officers, employees, collaborators, representatives or agents shall in no event be liable for any damages related directly or indirectly to the use of the Site, including loss of data or profit arising out of the use of or inability to use the materials on the Site.
  5. Use of transmitted material
    Persons who use the Site and transmit elements (content, information, opinions), in any way whatsoever, waive any moral rights with respect to these elements. They acknowledge that BaseDPsy may use, reproduce, publish or license these elements, without any compensation to anyone. At any time, BaseDPsy reserves the right not to publish or to remove any material received, at its sole discretion.
  6. Links to Other Websites
    BaseDPsy.com contains links to websites operated by other companies. Where applicable, it is important to note that BaseDPsy has no control over the operation of these sites. The fact that they are listed in its site does not in any way engage the responsibility of BaseDPsy.com.
  7. The use of the masculine gender
    The site uses the masculine gender most of the time in order to lighten the text on the pages. This standard is not intended to be prejudicial to women in any way.
  8. Testimonials
    The testimonials on the site have been published with the prior permission of the professionals involved.

METHOD AND TIME OF DELIVERY

  1. Software
    At any time, installation files can be downloaded by visiting the Purchase page and clicking on the “Windows” or “Mac” hyperlinks corresponding to the host computer platform. Windows platform users should also be sure to choose the product that matches their computer’s capacity: Read the minimum requirements for this purpose.
  2. Demo version of products
    The demo version of the “Mono” product is a “demonstrator” and has a limited time of use, 15 days. The “Combo” product has a limited duration of 30 days. Data inserted into the demo version of either product can be retained if the user purchases a license and inserts the license # into the demo version at the end of the trial period.
  3. Delivery Time
    If you purchase a license to use one of BaseDPsy’s products, that license is produced manually, not through an electronic procedure on this site. The license number is emailed to you in a PDF document. It is usually sent within an hour of purchase, but the delay can be up to 24 hours taking into account the time of purchase and a possible time difference.

About the “Runtime”.

The BaseDPsy “Mono” product uses “Runtime” as a stand-alone application to manage the data inserted into the “PsyTablet_XR” file.

The “Runtime” application is realizable using the kiosk application creation method provided by Claris FileMaker Pro 18, a subsidiary of Apple. This application creation method is no longer supported by FileMaker Pro since the beginning of 2020. This application, being the last of its generation, will not be adapted given the evolution of operating systems.

As a result, Alain Barbeau and BaseDPsy, cannot guarantee its current and future operation during future operating system updates.

If the Runtime does not work properly or stops working, you will be able to replace it with the latest version of Claris FileMaker Pro at your expense, or by using either of our other products, either the “Combo” or hosting your data.

In summary, we do not offer any guarantee of proper operation because we cannot control your IT environment. A demo version is available so you can check how it works before purchase.

REFUND AND CANCELLATION POLICY

BaseDPsy wants purchasers of its products and services via its website to be satisfied in every way. Most software is available in a demo version. BaseDPsy offers the opportunity to download these trial versions so that the prospective purchaser can confirm that they work properly on his or her computer before making the final purchase.

It is the buyer’s responsibility to try the software first to see if they are satisfied with the software before purchase.

Once the license # is issued, it is impossible for BaseDPsy to prevent the use of the downloaded and licensed software; therefore, no refunds are issued, once the license is issued.

The only refunds available are for purchases made in error and when the license # has not yet been issued. If you have made a Purchase in error, you must contact us immediately so that we do not issue the License #.

GENERAL CONDITIONS OF USE OF THE SOFTWARE

We offer a variety of tools for BaseDPsy PsyTablet users to properly learn how to safely use BaseDPsy. Because the software is installed on remote computers owned by the user and under the user’s sole responsibility, it is impossible for us to ensure the proper functioning of the software or the computer used.

The use of any of the BaseDPsy PsyTablet products is therefore made without any guarantee as to the loss of data inserted or entered into the software.

The license No. provided upon purchase of any of BaseDPsy’s products is valid regardless of the number of devices on which the software is installed. However, the software is registered in the name of the purchaser and the purchaser may not transfer the software or the license number to another user under any circumstances.
